Terms and Conditions

When placing an order with Flowerssimply you are agreeing to the following terms and conditions:

Flowers

Due to seasonal and local availability we cannot always guarantee that the content of your delivery will always match identically what is shown on this site.

In the interests of providing you with the best possible floral delivery our florists may substitute one or more items.

If there are particular flowers or colours that you would prefer to be included or even excluded, then we will do our utmost to meet your request. Please use the Special Instructions box on the recipient details screen.

Gifts

Should an item be out of stock, a similar product of equal or greater value may be sent, rather than disappoint and miss the intended delivery date.

Prices

All prices quoted include postage, packaging, delivery (as described below) and VAT at the standard rate.

In the unlikely event that an incorrect price is shown on our web site, Flowerssimply reserves the right to abstain from fulfilling the order at that price. The customer will be notified of the correct price and given the choice to proceed.

The prices payable for goods are as set out in our web site and are subject to change without notice.

Orders

You will be given clear instructions in how to complete the details required on the order form. By clicking on the 'Pay' button on the order form, you are consenting to be bound by these Terms and Conditions and those appearing anywhere on the Flowerssimply web site and authorise Flowerssimply to take payment for the item(s) ordered.

Full payment for all items purchased through this site is required before your order can be despatched. We accept all major credit and debit cards with the exception of Electron cards. All checkout pages containing personal information are protected using 128-bit encryption technology from the leading secure certificate supplier, Comodo. Flowerssimply reserve the right not to process an order if it is believed that the credit card transaction may have been made fraudulently. Under such circumstances the customer will be contacted to obtain further information.

An email will automatically be sent confirming that your order has been received and is being processed, please check this carefully. We will not consider ourselves bound by a contract with you until we send you an acceptance e-mail.

Orders cannot be accepted from customers under the age of 18 years.

Order Changes

If you wish to change your order we will do our best to make last minute changes for you but we can only guarantee changes requested at least 48 hours before despatch.

Order Cancellations

Orders may be cancelled up to 48 hours before the intended delivery date.

Delivery

Please see the delivery guidelines on our delivery information page. To help us ensure we deliver your flowers correctly please ensure the correct address details are provided for the intended recipient and contact details in the event of any delivery problems. Unfortunately we cannot be held responsible for orders being delayed by incomplete or incorrect information.

Should the recipient not be home we will attempt to deliver to a neighbour or post a card through the letterbox informing them that a delivery has been attempted. Please ensure the correct address is provided for the recipient. If an attempted delivery fails (such as the wrong address specified on the order), we reserve the right to charge additional costs to re-deliver or to deduct the shipping costs/product wastage/courier return fee from any refund if the order is subsequently cancelled.

There may be delays in delivery where a third party is involved, such as delivery to hospitals, hotels, universities, offices and ships as we may not be able to deliver directly to the intended recipient. Please note these circumstances are outside our control. In case of delivery to such locations, the signature of any person authorised to accept delivery on behalf of the organisation shall be accepted as proof of delivery e.g. receptionist or post room. To ensure the highest likelihood of delivery success please provide as much information as possible including department name, ward name, floor number, room number etc.

Our liability for non-delivery of the products shall be limited to replacing the product within reasonable time.

Shortages / Damages

We would appreciate that all claims for Delivery Shortages or Damages be reported to Flowerssimply within 24 hours of the delivery date.

Complaints

At Flowerssimply we are fully committed to providing you with the best possible floral gift delivery service. If you are not satisfied in any way with the service that you have received please let us know and your complaint will be investigated. If we are satisfied that your complaint is genuine a replacement or refund will be given. This does not affect your statutory rights as a customer.

If you are dissatisfied with the service you have received please notify us within 24 hours of delivery and retain the item concerned. Complaints on quality cannot be investigated if made later than 7 days following date of delivery. All these items (Flowers / gourmet hampers / chocolates) are perishable in nature and so cannot be returned under the distance selling regulations.

Limitation of Liability

In no event will Flowerssimply be liable for any damages including, without limitation, indirect or consequential damages, or any damages whatsoever arising from use or loss of use, data, or profits, whether in action of contract, negligence or other tortuous action, arising out of or in connection with the use of the site.

Force Majeure

We shall have no liability to you for any failure to deliver goods you have ordered or any delay in doing so or for any damage or defect to goods delivered that is caused by any event or circumstance beyond our reasonable control including, without limitation, strikes, lock-outs, terrorism and other industrial disputes, breakdown of systems or network access, flood, fire, explosion, accident, acts of God, acts or omissions of the Purchaser.

Disclaimer

Flowerssimply does not warrant that the functions contained in the web site will be uninterrupted or error free, that defects will be corrected, or that this site or the server that makes it available are free of viruses or bugs or represents the full functionality, accuracy, reliability of the materials. This site and the information, names, images, pictures, logos and icons regarding or relating to Flowerssimply and its products and services (or to third party products and services), is provided "as is" and on an "is available ” basis without any representation or endorsement made and without warranty of any kind whether express or implied, including but not limited to the implied warranties of satisfactory quality, fitness for a particular purpose, non-infringement, compatibility, security and accuracy.

Privacy Policy

We are committed to protecting your privacy (in accordance with the Data Protection Act 1998). We shall only use the information received from you for the purpose of processing your order and to provide you with the best possible service. We will never share your confidential information with anyone, and will not e-mail you in the future unless you have given us your consent. See our Privacy Policy.

Flowerssimply reserves the right to supplement and amend the Terms and Conditions. It is the responsibility of the customer to review the Terms and Conditions when using the web site. They shall be governed by English law and the parties hereby agree to submit themselves to the exclusive jurisdiction of the English Courts. These terms and conditions do not affect your statutory rights.
